Did you experience this while going down-slope (even very gentle gradient) with intention to accelerate but decided not to and the gear just stays on low and refusing to change when it clearly should ?
I do experience this as describe above with the E60 (and even with my E39), but this only happens once in a very very blue moon !
I usually switch to the steptronic manual and shift to a higher gear.
