Was hit by a drunk driver last night

1st things 1st: I hope you and your son have prayed and thanked god that you are both safe and bore no injuries from the acc.
#2: Does the on-site police report mention anything such as "the driver of the Neon spoke incoherently and could have been under the influence of judgement altering substances" or "there was smell of alcohol in the breath of the driver of the neon"
#3: Do you know what the BAC level recorded at the cop station was?
#4: Do ask your attny about possibilities of punitive damage.
#5: At the time of approaching the other driver's insurance company (if it covers damage, considering this may be positively a DUI case) then do not hold back on the repairs and replacements on your vehicle. Possibility of full car body paint (as you can claim there will be a mismatch with front and rear halves); complete replacement of all parts damaged and "possibly affected" such as sensors / tanks / hoses / gaskets / etc.; Rim and tires; etc... I would take MAXIMUM advantage here!! Hey, why not!!
#6: Contingency claim option on her insurance agency within a stipulated period of around 3 months- eg suppose even after repair, there is still some damage which may become apparent or come to your notice which may cost additional- then her insurance should pay.

Glad to hear you and your son are both okay.

*IF* they don't total your car, and I'm no expert no do I know about Nevada's laws, but something else to look into (and discuss with an attorney) is diminished value. Insurance companies try to fight and weasel out of it, but if your state allows it, you should fight for it.

Contact an attorney immediately. They will guide you through the process and have you get checked out. No price can be put on the mental anguish that may follow.....even if you did make a recorded statement already saying "we're all ok, no injuries"
I did get an attorney on friday. With that, was sent to a doctor that day. Had xrays done, and went in this morning for an update. Looks like I'm suffering from whiplash at the moment, but nothing is broken, or out of place. I do need some adjusting though. All is being recorded, and documented for the attorney's.

Yes, you still have to make payments. Doesn't matter you had an accident or not, that's your car and you made a commitment to buy and pay for it. Anything happens in the meantime, you're responsible. Same holds true for all things in life.
Yep, found that out. Not too happy, but, its what I gotta do since I did sign the contract.

Don't think your car is that bad since the wrecker drove it on the truck. No leaks or anything? you may have a bent front end frame but it's probably unlikely if it didn't impact the wheel. With that said....I don't think your car is 80% damaged to the cost of appraisal so your car will get a fix. But after that you can keep complaining

Take it to a recommended shop that deals with BMW. Dealer should be able to recommend one. Visit their shop. Notice the cars on the lot. Read reviews. Look at their paint booths (most important) and look at their storage lot.
I did. I called my sales man, and he told me to use the collision center thats attached to the dealership.Which is great, because they are the only shop in the state with the correct tools to fix this girl. Saw plenty of other BMW's in the lot, and the lot is secure. Now just waiting for the Ins adjuster to show up, so they can start.

The little print out paper they gave me at the scene didn't have that info. But the report does say a Breathalyzer test was done at the scene, and blood was drawn at the jail. Waiting for those test results to come back (they are behind t the moment)

I did ask, and they will work on that. One of the reasons for the doctor visit.

I'm not holding back on anything. Nor is the shop manager at the collision center (or so he told me today) He's had great dealings with Gieco, and knows how they attempt to skirt around repairs. He assured me my car "will" be done right. I did show him the damage to the passenger side wheels, when I hit the side walk. He marked them, and said those, and probably the tires will be replaced. If the paint doesn't match up, it will be taken back to be fixed. ( back in the early 90's I worked at a dealership, so I do know what to look for)

Again, thanks all for all the kind words for my son, and myself. At the end of the day, thats all that really matters to me. Even the cop was like "wow, your very calm for somebody who just had a very beautiful car destroyed" As I told him, ya, its a beautiful car, and ya, its f***** up, but don't care. My only care is my son, and his well being.

Only update I have at the moment is this.

I guess my attorneys contacted my insurance company (Farmers), and a adjuster went out today to have a look at the car. He called me earlier while I was asleep today (had a late night with the Scorpions - Cinderella show last night). So I called him back, and he informed me that his calculations at the moment had the damage around $23,000, and that it just maybe totaled.

I haven't heard a thing from Geico yet, and I'm waiting for my attorney to return my call.

Most importantly, you and your son are safe and sound (a testament to the integrity of the safety systems incorporated into the E-60). As beautiful as your car was, it can always be replaced by another E-60 or a new F-10.

The attached pic is what it should look like with the bumper removed. The heat must have been tremendous to melt your windshield washer bottle and I see your horn (on right side usually) is nowhere to be seen. There must have been a few parts left behind. It also looks like the rad has been damaged enough to require a new one. Hard to tell if the frame is damaged.
