Was hit by a drunk driver last night

So glad you and your son are ok. It seems that drunk drivers can never crash into a tree or something...they always end up crashing into someone else... :thumbsdown:

Cars can be replaced. Good thing you and your son are ok! That's why you are driving what you are driving, not only for performance, but for safety also

Knock on wood I haven't been in a major car wreck yet, but if it's any consolation, I've been rear-ended 3 times in a 1 year span (actually my car is scheduled to go in for the 3rd time for my 3rd accident on August 9) and some people just shouldn't be driving at all!

The first accident is probably the typical one... Unattentive driver didn't calculate the braking distance on the freeway when there was a sudden stop because of traffic.

2nd Accident I had was at a stop light. Was the 2nd car at a stop light waiting for the light to turn green, the light turned green but the car in front of me didn't go yet. I honked and BAM I got hit from behind cuz the unattentive driver behind me PRESUMED we were going to move forward once the light turned green (which is a DUHHH but obviously I couldn't go yet because the car in front of me didn't move yet)

My 3rd accident (just happened this last July 13) is probably the saddest of all of them... I was rear-ended at a drive-thru because the idiot behind said his foot "slipped" off the brakes..

Goodluck with the insurance and if they're giving you a hard time, don't budge in! I've gone thru this 3 times already, one wasn't on the insurance policy of the car she was driving, one had an out of state "mom & pop" insurance company, and luckily my 3rd one was the same insurance company as me.

I'm not too sure if they did a breathe test on her once I left, but know he didn't do one while I was still at the scene. Yes, she was arrested, and taken to county jail. She wont see a judge till Monday. The paramedics did show up, but myself, nor my son needed medical attention. I did see my attorney this afternoon, and I did go to my doctor right after to get xrays of my neck, and skull. Yes, there was a witness, who was two lanes over, who did stay until the police arrived. The cop talked to her for about 4 to 5 minutes and got her statement. I have the on scene police report, of which was giving to my attornet, and insurance (hers and mine).

I also called the dealer today, and my sales man told me to contact their BMW Collision Center. My car was picked up from the tow yard it was taken to last night, and is now sitting at the BMW collision center. I wont know the extent of the damage until the insurance adjuster goes to their shop, to investigate it. Once they are done, the center will pull in, and tear it apart to determine if it can be repaired or if it needs to be totaled. If it can be saved, their goes that value of the car. I could care less if its its an insurance company approved shop. Its a BMW, and its going to a BMW repair shop. If they don't like, then my attorneys will help them like it.

Its amazing when the innocent folks like my self are now on the schite end of the stick.
Yes, I do have GAP insurance, along with any other service BMW has. My 5 was/is completely covered.

Would love to get a rental, but can't. I didn't have that on my contract, but hers should be proving me with the rent a car. They just wont yet until they contact the woman that hold the insurance on the car.

Thats the #1 one reason I picked a BMW. The safety of my children, wife, and myself. The styling, comfort, agility, speed, orgasmic feelings were all secondary for me.

And yes, just confirmed, she was given a Breathalyzer test at the scene, and had a blood test once she hit booking. So they will know exactly everything, and anything she was on.

Most importantly, you and your son are OK and the 5 Series protected you. Smart move to see an attorney and a doctor. Sue the cretin!!! She could have killed you and your son. She should pay.

It could have been better: the driver could have zipped through the intersection and nobody was hit (yet), or it could have been worse if the driver t-boned your car. Best thing is neither you or your son were injured.

I know how you feel , and is sucks ! But just thank the powers that be , that your son and you are ok. All the rest is material,and will be behind you before you know it. Keep us updated .

Glad that you and your son are okay.

As for the car, I'm sure the repair bill will be high, but it is more likely fixable than not, so don't worry
