Ya, I have an appointment with an attorney today, and a doctors appointment for both of us. I have full coverage on my car, and the car that hit also has insurance, but don't know its it full or liable only.

Only allow repairs at the BMW dealer and their approved body shop.
You'll be ok one way or another on the insurance. Either the other car has adequate coverage or your Uninsured Motorist or Underinsured Motorist will kick in.
You have to pay you next payment. The loan company doesn't care if the car is disabled.
You should be able to get a rental car. Many states allow for a "comparable" rental car. In Virginia, for example, if you were driving a minivan, they can't put you in a Yaris unless you agree.
If it IS by chance totaled, do you have gap insurance?
You may owe more on an '08 535i than it's worth.
For example...if you still owe $30k in payments, but the vehicle is only deemed worth $27k by the insurance company, then YOU will have to pay the $3k difference to the bank. Time to go after the drunk's insurance company. But good luck with Geico. You'll spend more on atty's fees than it's worth.
Considering how fast 5-series depreciate, I added gap insurance when we purchased our '07 550i a month ago. I'd hate to have an accident six months from now and owe more than it's worth.
Glad you and your son are OK. My 21 month old son is the reason we bought our 550i. My wife's /M Roadster just didn't seem practical anymore.
Protecting and raising our children is our reason for living IMHO. Glad your little one is OK. Pat yourself on the back for picking a safe car. Good job, Dad!

Did the police come and do a breathe test on the spot on the driver that hit you?
Was she arrested? Did you press charges afterward? Did you ask for or seek medical care at the scene just in case something might have happened to you or son as a result of the collision? Were there any witness statements to gather? I would think your attorney and your insurance company would need to know these things.

Glad to hear you are both OK. I just went through a bad accident in January.
As noted earlier, you will still be responsible for your finance payments.
I doubt your car will be a write-off. A 2008 is worth too much to replace. Without the benefit of pics, if your front tire was missed you may have damage to your bumper, fender, grill, hood, headlights etc. These are all easy to replace.
Absolutely insist on BMW OEM parts and paint. I saw the parts in their original boxes and got a detailed list of the parts that was sent to the insurance company. I also met the insurance adjuster at the shop to discuss the claim and what he saw and approved.
I used the body shop that my dealer uses and was very pleased with their work. They were not an insurance approved shop but a tour of the premises convinced me of their quality. The place was packed with BMW, MB, Jags. I also asked the adjuster about the quality---after all, they are the ones writing the big cheque.
Insist on visiting the car to monitor progress and take lots of pics---its your car. Don't accept it until its perfect.
You should be able to get a rental since it wasn't your fault but check with your insurance to confirm. You MAY have to pay a deductible if police reports aren't available when you get your car back. I was fortunate that the preliminary police report assigned 100% blame to the other driver so the deductible was waived at pick-up. Please note that the deductible would have been returned later to me once a report was available to the insurance company.
One last point---I insisted the insurance company pay for a BMW dealer to check out the finished car as if it was a lease return and documented their findings. In my case, the entire rear left side suspension and rim were replaced but the entire car checked out perfectly back to factory specs. I wanted this for when I sell the car in the future. Like you, I own my vehicle.
