I'm surprised that BofA denied your refund. I ordered my kit and paid $1995 thru Paypal (from my BofA card) on May 3rd. After two months and no kit, I finally decided to make a claim. Unfortunately Paypal wouldn't do anything after 45 days, so my next option was to contact BofA. Their policy limits claims over 60 days. When I finally filed my claim, it was actually 62 days after the purchase date.

When I talked to customer service, they told me to send as much documentation as possible to back my claim. I ended up sending about 10 pages of correspondence between Quad and myself. Everything including his initial reply "promising a GUARANTEED 3 week turn around" to excuse after excuse each week.

I also tried inquiring through his Ebay store about a kit painted in AW for my E60. He told me that he had an AW kit in stock and was ready to ship (this is about 7 weeks since my kit was ordered), but he needed a wire transfer to complete the transaction (instead of Paypal). After I told him that I was actually the same person that had ordered from him through this forum, I never heard from him again.

Luckily, BofA just contacted me last week and said they are going to go ahead and process my refund. I ended up ordering my kit locally from BMW which I should have done in the first place.

I don't know if it mattered, but I have been with BofA for less than two years, but I do spend about $10K per month for my business and pay in full each month. They have raised my credit limit three times in 18 months without me asking for it.

Anyway, since I am getting a refund, I don't know if I can still help with the civil suit. But I am willing to help in any way to get this a**hole and let him get what he deserves.

One other thing - I think all of you should file a complaint with the Internet Crime Complaint Center.

I have a set of M166 (M6 offset) rims that I ordered from Tony and for now I'm going to trust Tony will do the right thing and be a standup guy and ship the items that have been bought.

I'm going to give some time before I do anything.

To Tony: Why not surprise some of the members by shipping 5-8 kits out next week? -- It would defuse the present situation and make some people happy.

I'm still waiting for my rims and thanks for communicating on the 29th, I appreciate that. I do expect to get the rims soon and please send me a tracking number when it's sent.


I'm going to give some time before I decide what I want to do. I'm not a foreigner by the way, I'm from the USA and do know my rights and ways to resolve this kind of situation if I need to.

So as a Christian, I'm going to give the benefit of the doubt and trust Tony.

(presently with no wheels because I sold my wheels last week expecting the new ones to arrive this week. So I do need to give the wheels to the guy who bought my old ones within ten days!)
