Ken should not only get the car he rightfully won, and deserves, but, the dealer should pay his legal costs as well.

I would like to see Ken rip them a new one.....

And when he does, at least this forum has a great legal department as well if anyone ever needs one...

Its been awhile since I took Business Law, but I always thought an agent's (in this case - salesperson/dealership) actions when conducting business are an extension of the corporation and both can be held liable for such actions.

You may be right but in my lay understanding I imagine, BMW NA has a really great legal team and really nifty legal mechanisms to disassociate itself from the dealers and any bad publicity resulting from bad practices on their part.
I would even imagine they would as a final act of distancing revoke the franchise license.

Yes you are probably rightm but perception is reality and dealing with perception is more important than being legally right/secure.

Yeah, BMW NA will look at that dealership differently. Negative press from a dealer is not a good thing.
