Is this still an issue I can have my car looked at for? It is also out of warranty is that alot of cost to me?

ISTA-P, BMW standard tools, power supply (something like below which is what I use) a BMW ICOM, and a laptop or Microsoft surface pro. If you're doing it yourself make sure you get an ICOM from the dealership. They are currently around $500 on http://BMWPartsPros.com
It's best to do it in ISTA-P (make sure the DATEN files are up to date) with an ICOM. If it's something you're going to only do once and never use again it's not worth it. But if you're going to be always working on your car yourself and continue to buy BMWs you'll definitely make your money back. The programs are free you just have to google it or you can buy it and have someone install it for you. DO NOT BUY CHINESE ICOM you will regret it.

WIll a K- Dcan cable work with a power regulator??
or even bimmercode??

You risk bricking your modules. I would only use a cable to troubleshoot and code. For updating always use ICOM. The connection is stable and transfers data at the rate it should be transferred. Don't get me wrong some do use the cable to upgrade and have been successful but some have not and spent more money to get it corrected.
