Alright so taalked to my service advisor today (hes amazing) they were for certain that replacing the dem was the fix to our problem.....well they replaced it and now the overheat messege is not appearing on my screen but now when they actually check the temperature the car is reading 15 degrees higher than it should be. So we are back at groubd zero. They have been in touch with bmw engineers and they suggested maybe a blockage but that was not a for sure suggestion so my SA is waiting on a final email from the engineers on what should be addressed next. Basically their on standby to take my engine apart.....

VERY soon you need to be finding an "amazing" attorney. This is getting way too deep. I would be screaming for a collateral swap if the car is financed. Good luck!

Can anyone explain what exactly a collateral swap means?

More like the BMW swapping your current car with another one (minimum same value) against your loan.

One one hand, your car has spent way too much time in the repair shop. On the other hand, it seems like they are making a solid effort to fix it and they are giving you a loaner (free with unlimited miles I assume).

I would start pressing BMW for another car since they haven't fixed the one you have and its' eating up your remaining warranty time. At a minimum I'd press for a free warranty extension from BMW directly or one of its preferred warranty companies like Fidelity.

This post is like a drama series that leaves you at a cliff-hanger every time Superstyna leaves a post. Awesome. Sorry for the situation, but awesome read.

lol it definitely is like a soap oprah!!!!! after the phone call i just recieved i dont know if a collateral swap is in my near future....

so must current update (still no car) & (still not fixed) oh & (still dont know whats wrong)

BMW usa just called me "Surge" ive talked to him 3xs now hes the one i initially called. Well he really lit a fire under my booty! so he called to say the GM denied the request to eat my car payment because I 1. have had loaners all the time since they've had my car 2. because they have done all this work with no charge to me & 3. because the mileage on my car (92k) still in warranty i must add. He said these are all factors as to why it was denied at this time. Do i need to skip a car payment? no! but the fact that they are making it seem like i should be greatful at this point is ridiculous in my eyes!!!

So "Surge" continued on to say well christyna theyve done multiple repairs now at no charge for example they are doing your 90k service at no charge.... wooowwww thank you soooo much!!!! not! maybe im being a brat?

He also stated "have you not had dealer provided transportation during this time also?" uhhh yes surge i have...but also im paying for a 5series awd vs a 3series rear wheel drive..which in the nw makes a huge difference.

So i went into ask....so is this normal? that ive been without my car since 4/20/12? and he said of course not but we want them to have enough time to really know whats wrong....so i ask "what is wrong, has 2.5 months not been enough time?" and he replies "we dont know, engineers are looking into it also" so i said oh...again? so you want me to be greatful that they have replaced all these parts at no charge to me, parts they thought was the problem but clearly isnt and you still dont know whats wrong with my car or when ill get it back?

im so frustrated guys!!!!!! im going to call my nice SA in a bit...i just need an hour to cool off so i dont take it out on him. =[

Because you're a female they're going to take you for a ride. They sure covered their ass by comping you with a loaner but this won't tell what's going to happen afterward. I would start by 1. stop being so nice. be firm and make demands
2. if they do not meet those demands I would see an attorney about it.

Sure you've had a loaner which is nice. They're doing all this maintenance to your car supposedly and give you a loaner. But this drama has gone on for a long time and at the same time you're eating car payments AND you do not know what's going to happen once they supposedly fix the issue. Demand to get the warranty extended because after nearly 3 months you've lost confidence and your experience with BMW has not been pleasant.
Last, get a list of parts replaced which should include suspension componenents at this mileage. If they're doing all of that, I would ask simply for extended warranty and keep driving their loaner. And if it goes past 90 day mark, they need to start making payments on your car.

this story is so crazy now you may have to get a lawyer which is gonna cost you money. I'm really sorry that bmw is treating you like this. they really need to just give you another car and done.

A word of caution! To say that I feel your frustration is a gross understatement. During this madness I strongly suggest that you do not commit to no longer making payments on the car. Not making payments will seriously impact your credit ratings and in the end make future auto purchases very difficult.

I would also suggest that you contact your Attorney General's office for advise and direction.

Good Luck
