Was hit by a drunk driver last night
Hello all.
My son and I were hit by a drunk driver last, who ran a red light. My light turned green, and went as normal. Had an SUV to the left of me , which block my view of the oncoming car to the left. The SUV braked, and as I looked to my left, I saw the dodge neon, coming thru the intersection. Applied my brakes, but she plowed into my drivers side front end. She missed my front drivers side wheel, but took out the fender to the bumper. Car was still running when my car came to a rest, and I sat there for a min or two. The tow truck driver drove my car onto his rig. So I don't know if its fixable, or trashed.
Any how, I'm not leasing the car, but am making payments because i was buying it. This is my first accident in my 42 years, so I have no idea what I get to look forward to. Ive already called my insurance company, and the drivers insurance company. What do I do on the dealership end ? I still have to make my payment on the 10th right ? What happens now ? Do I have to start the whole process over, with getting a new car, or equivalent to my 08 535I with only 22,635 miles.
Just looking for some guidance folks. Thanks

Well, for one thing, contact an atty quickly. Since the other driver was drunk it is unlikely that their insurance will cover damages, they tend to look for ways out of it and committing a crime during which you have an accident is a good way, like DUI, driving with a suspended/revoked license, etc. They will not cover those drivers even when they are insured normally. I'm say this mainly because while I am not an atty, nor have much idea about the laws in your state, my Dad has been in insurance for more than 50 years - I've learned a little.
I also hope you and your son are okay, don't worry too much about the car, it can be replaced.

I hope you and your son are okey. Regarding your car, make sure you get a police report and proper documentations(insurance, drivers license from the other party). If the other driver is documented DUI then there won't be any issues. Witnesses if any will help. Call your insurance for the claim and asked them if you can bring it to your choice of carshops or asked them a list of their accredited shops. Go from there.
Yes, my son is ok. He was scared last night, and had a little trouble going to sleep. But he's up this morning with no pain anywhere, so that great. I'm ok, I don't feel any pain or side effects from it. Just pissed off more then anything.
I have already called my insurance company, I have called hers Gieco (even though the policy is under somebody else's name, from another state.,.,Washington,I'm in Vegas ), next is to call and attorney (which the wife is doing at this moment), then my sales man at BMW.

Glad you're both okay. Either way, take yourself and your son to the doctor to get checked out. You might not feel anything right now, but even a week from now you may start feeling sore. Sounds like you were hit sort of from the side. Your neck may not be as resilient with side impact as from one from a rear end impact. Good luck!

This actually happened to me in my first car, I was at the top of a hill making a left, got the green turn arrow and started through the intersection when my friend noticed we were about to be hit. I couldn't see the guy because of the hill. He had no license, no insurance, and was very drunk, I had only liability (I was 16 and paying my own insurance) so my car was a total loss and nothing I could do.
