Kinda what I thought, but this is comming from my mechanic friend at the dealership, he is the only one that I allow to work on my car since new and works on my car off the clock at the dealership. I know he is opening a puma case to have it covered by them as far as parts coding and shipping to a fro. I thought it may have been a vanos issue bad sealing rings or something and in the end he will probably get the 250 charge off also he normally does.
I questioned the SA about the cost because it seems kinda silly for me to pay for a TSB but we will see.
He has never (the mechanic) steered me wrong so I can only go with what he says right now, will keep the forum abreast of the progress or lack there of

Well like I said I will soon see and as for the friend comment he is a friend outside the dealership as well as inside has never steered me wrong. When everyone and all bmw literature was saying I could not get bluetooth intergrated in my 04 car he got it to work, when my car was out of warrenty and I needed new head lights because of plastic faded, he got me new ones under warrenty, disa valve covered new steering wheel peeled covered, new cd player covered, put my coil overs on for 100 bucks and aligned, leaking valve cover gasket 50.00 bucks, ipod intergration installed and coded 75.00 bucks aux install and coded 50 bucks. Never need to make an appointment and still get loaners. So trust me I am cautious but, confident in his abilities that if this does not work he will find and fix the issue.

Well Guys got the car back Friday and the hesitation is gone the car has not ran this smooth since new seems that the old reprogram the dme thingy worked and I can say that my FRIEND once again came through.

M54B30 MS45.1; Engine Power Drops at 4000 RPM
MODEL
E46, E60, E85 with M54B30 engine and manual transmission only
SITUATION
The customer may complain of an engine power drop at approximately
4000 RPM during aggressive acceleration.
CAUSE
Ignition timing retardation shift due to unfavorable knock adaptations
in the 4000 - 5000 RPM range.
CORRECTION
On a customer complaint basis, perform the procedure described below.
PROCEDURE
1. Verify the complaint. This situation can vary from a slight surge
to a noticeable drop in power during hard acceleration.
2. Do not replace any parts!
3. Submit a PuMA case requesting authorization for DME shipment to
Engineering Department for reprogramming. For the PuMA case title
please use the following: "MS45.1 DME KNOCK ADAPTATION RESET".
4. Reinstall the DME.
5. For E60 only: Reprogram the vehicle using CIP 19.1 (Target Data
Status E060-05-09-530), or higher.
WARRANTY
Covered under the terms of the BMW New Vehicle Limited Warranty.
For the appropriate labor operations please refer to the KSD system.

Good deal. I still do not see why they would need to bench program a DME vs. doing it in the car. I have NEVER heard of this. How much was it altogether if you don't mind me asking?

I know man that is kinda why i felt I was being f'ed over a little but my friend assured me it was legit. It cost me 250 I guess it was shop time cost. I will however try and get some of my money back because I complained about this when the car was still under warrenty, it is documented but they could not reproduce the issue. I hope this helps any other member with this issue.

This is extremely strange. My guess is that your shop is using online server and either something wrong with server, they cannot connect for extended periods of time, they've been having weather related issues which affects stability and the cost of losing a DME is greater than that of shipping it into them. Or could be that they suck. lol

Funny they do suck except for my friend of course and the head SA over the sealer ship they have my back at least they seem to. I guess that is it with the program they don't want the liability of that so BMW NA lets the engineers handle it.
Kinda like my company I work for the public says they suck balls but the techs are great go figure
