I briefly talked to the dealership about the 2006 but they said no. Since they were actually working with me on the buyback I was not going to push it. 
My car had over 20k miles on it from about 9.5 months of driving.
Good luck. I actually never did have to talk to BMW NA - I was happy with how the dealership manager was handling it.
