I believe you Guest! We had a similar issue w/ my wife's Acura MDX when we first got it, where she would not tighten the gas cap and get a warning light. I am very aware of the issue on modern cars and if anything over-tighten my gas cap. I also know to never pump gas w/ the engine running. I didn't buy the loose gas cap code, but since it has not happened since, I have nothing to go back to the dealer with. I'd stay after my service dept if I were you.

IF they have tried to fix the car 4 times and the car is still doing it you can inact the Lemon Law and have BMW do a buyback. You then can get a new 5.

Please check the Lemon Law in the state of your residence carefully. In some states, you must prove that the problem that may cause death or serious injury which has not been repaired after several attempts within a specified time.

From the many follow on posts, it does not appear that this particular problem may cause death or serious injury. If it is in fact caused by the owner's failure to tighten the gas cap, then you definitely have no Lemon Law case.

A loose gas cap is the cause of unnecessary, but polluting, gasoline emissions -- the gas cap is specifically tested in California during the Smog Check.

its not the gas cap thats the problem, as for lemon law I think in california its 3 times same problem in 1 year, doesnt matter if it may cause death or serious injury. I bet if you complained to head office, they would give you a new car, if it doenst corrected asap. thats what i'm hoping for.

I'm having that problem too. My Service light comes on and says higher emissions, and I also get the gas cap light coming on every once in a while. I just never had the time to take my car into service. I thought the issue might have been related to my eisenmann exhaust and having the resonators taken out, but maybe not since others are having that issue. I was also told that it's a software issue. Hopefully it'll be easily fixed with the new software upgrade that became available about a month ago?

I have a service visit scheduled for this very problem. They said "check your gas cap", which I of course already did, based on this board's advice. No problem there.

I will post here on what the dealer says/finds/solves.

happened to me at about the 3,000 mile mark...then went away - seemed like it lasted for a month or so(warning light coming on) - then went away with a software update or over time...

Not sure if this matters, but I have heard if you top off the tank it can cause problems with the recirc system? Sounds like if the gas cap has an effect on this, that something may be going on with this part of the system.

I had the same happen to me at about 5k miles.I checked the gas cap as well. It was on tight. Besides what you mentioned my car also lost power. They ended up doing a software upgrade and they replaced a part. Something to do with the throttle body I believe. Hope this helps!
