Good question. I have the same problem. Bird droppings were on my hood for about 2 hours until I could get home and wash them off. This is even after waxing the car. In the right lighting I can see the etching of the paint. It's not too noticable though because right beside that someone keyed my car? :'( and put a 2 foot long scratch down the hood and another 6 inch scratch right beside that so it kind of takes your eyes off of the etching.

No.

I had the car cleaned and waxed when a bird decided to... you know... I saw it happening but didn't had a gun to kill the bird , so I took warm water and tried to rinse it off. While it was making it way down it left a fine little scratch in my paint ! Off course I then took it off and rinsed the car immediately after, but that shows how BAD the paint/clear coat is that BMW uses.
Or is that one of those "the nature strikes back" things?

That was a fast reaction. Wonder where that bird had been dining! Diet may have something to do with it. There is also the possibility of super fine grit from the crop doing some damage. All of those rocks have to be replaced daily because they get ground up. Very aggravating, I'm sure. These are such pristine cars that anything other than perfection takes on the image of a major flaw.

May BMW intends the clear coat to be weak so it is easier to buff out small defects? If it is as thick as someone else posted, it just may be a little polishing that is needed to remove the etched paint. BUT, if I am correct, then BMW should stipulate that the finish will withstand 3 or 5?? paint rubdowns as delivered from the factory. I have heard of such ( hidden from the customer) specifications for other cars in the past. What about e60?

I complained about it, and a BMW rep checked my paint and told me it is normal, even thicker than normal, and it will survive 3-5 paint rubdowns without a problem.
For me this means, they know about the bad clear coat and made the paint thicker...
Anyways, with all the crap that is landing on my car, I will have 5 rubdowns in the first year... and then what???

This is by far the best CAR I've ever owned and driven, but it's also BY FAR the WORST paint quality on a car I've ever seen!!

I've read in a couple of places that the paint used on all cars had to be softer after 2000 or 2001 because of the complex curves of the newer vehicles and that the auto care industry had to reformulate its products (wax, polish, etc) to account for this.

Maybe Iceman's experience proves this.
