Sorry for replying late:

Yes the module will need coding, it is located behind the glovebox compartment.
I saw you already purchased one, that might be a bit premature unfortunately, may cost you a restocking fee in the end.
I would proceed as follows:
visit dealers/independents until you find one who is knowledgeable on this issue, my bet is that even with the limited numbers of Tourings there will be one who has come across the issue.
Discuss the problem and pick their brain, you'll know soon enough if they actually know this issue and remedy or are just 'mindless module replacers'. Now if I'm not mistaken this issue will possibly not throw an error, the dealer involved in my case knew that the body module was a potential culprit just from experience.

On the bright side it may get you a reliable, knowledgeable dealer address in the process. And that's just invaluable.

Back to the issue: what animal said (lock) might be the issue, however if the locking movement seems correct, just off.. if you know what I mean, chances are the unit itself is ok.
I would find a working Touring and compare the lock movement to be sure.

Hi,
I bought a 2006 530xi. I'm having the same issue with the gap on the left hand side of the rear hatch door. I didn't see a fix for this. Just wondering if anyone ever found a fix?

Default Tailgate latch

The tailgate has a double latch system. The latch hook on the door grabs the post on at the threshold of the rear opening. The post is mounted on a motorized swivel which rotates 180 deg. to pull the door in tightly. I am not sure how the timing of the two latches mechanisms are activated. When both latches work properly everything closes and end switches confirm the door is closed. The problem could be either of the latches, the switch that proves door closure, or an alignment issue on the door. The rotating post moves toward the side when it does the 180 deg rotation. The door has to be aligned well enough to be able to handle this small amount of side to side movement. There are side alignment guides on both sides of both the body and door which assure that the door is centered when it is pulled in to the closed position.. There are adjustable guides on the bottom of the door which assure the is closed to the proper tightness. There must be some degree of flexibility within the door and/or latches for all 6 points to attain their proper location when the door closes. If the guides and hinges look good, and the vehicle has not had body damage, the latches or door switch may be the problem.

my 09 e61 is having this same problem it would go away and come back and now the glass hatch will not open
