But with a totally software controlled clutch, how is that reasonably possible? Sure, driving like an idiot may well lessen clutch life, but the actual engagement/disengagement is handled by BMW's software engineers and much as in the Steptronic it should be very difficult for a user to "abuse" the drivetrain in the same way you can in a manual transmission. This is even more so in just a couple of thousand miles. US cars don't have LC, so what can you reasonably have done? If as you say the failed parts were fitted in July, the finger must point to either a faulty part or a sub-par installation. I also believe that BMW has access to a lot of data showing precisely how the car has been driven, so get them to show you their "evidence". Right now, all I see is the dealer/BMW NA not taking responsibility - get them to put up or shut up.

I had the clutch and SMG control unit replaced under warranty by my dealer. They went just before 32,000 mi. Your dealer should cover it, unless you've been launching it.

did you contact the place that the last owner got the clutch changed at, to see what they might say?

IT IS OFFICIAL AND EVERYTHING HAS BEEN SAID:

BMW OF MANHATTAN ARE ALSO SCUMBAGS.

BMW OF NA OFFERED NO ASSISTANT AND LEFT ME OUT IN COLD ON THIS MATTER.

AND BMW OF MANHATTAN CORNERED ME INTO PAYING FOR THIS LEAVING ME NO CHOICE BUT TO PAY..

BMW = SCUM

If you don't want to involve a lawyer, how about contacting the consumer advocate in your area from the local newspaper or news station to get your story in public?

Man, they are giving you a raw deal. A friend of mine dealt with a similar situation on an E55 AMG. His transmission failed twice in the original warranty period. First time was repaired no issue. The 2nd time, the dealer and MB Corporate chalked it up to abuse (hello, abusing a 400+ HP car? what the hell are these things made for?).

Persistence is key. He basically got a lawyer (which he didn't pay for, family member, might not be worth it for you to pay for the lawyers time), and went straight to the top. The lawyer called the corporate office until he spoke to some Public Relations person, who conducted a private audit of the persons experience/situation, and sided with my friend. They fixed the transmission again under warranty, but it took 4 weeks or something of fighting.

Don't give up on this, especially when people are saying they had their SMG repaired under warranty. I wish you luck.

NO sir!! I wanted to lemon my 530 for several problems... i bought it CPO 2nd owner.. consulted with my attorney and in my state florida... Lemon only applies to 1st owner.. they are trying to change it though my laywer said.

Pretty sure that varies state by state. Here in CA, I think it is indeed possible to lemon a pre-owned car (provided some manufacturers warranty still covers the car).
