I would expect the dealer / BMW to replace this faulty jack. IF it was abused by previous owner the CPO inspection process should have picked that up.
IF the dealer was sloppy or lazy and failed to notice that an important piece of safety equipment was not replaced the product liability exposure would be HUGE!!
OH - one other point - CPO right ??
