price is good considering the car's specs... HOWEVER, you have NO WARRANTY... AT ALL
if anything goes wrong, and chances are it will you will have to pay for any and all repairs... mechanical or electrical.
remember, these cars are rolling computers systems. they "hiccup" every once in a while and have to be sent to the dealer for repairs/upgrades... dealers charge about $120 minimum an hour for pretty much anything...
you should carefully consider another car that has original FULL BMW warranty (car with less than 50,000 miles) or is at least a C.P.O. (100,000 mile coverage is a great peace of mind in my opinion). you might pay a tad more upfront but it might pay off if something was to go wrong...
just my .02 cents

echo the above. My 04 545, which I have had for almost 6 months now, and which has 48k miles, has been in the shop already for: new clutch (as a result of constant creaking, which, by the way, is still there), new door seals, and new airbag seat sensor. If I was out of pocket for all those, it would have probably been $5000 worth of repairs. (the door seals and seat sensor are about $1000 each to fix, and are common problems with these cars).

+2 -- These cars are very finicky - my E39 540i/6 was always getting something repaired. My 550i has been acting like a good girl :--) lately...

NEVER own a BMW WITHOUT a warranty, regardless of how appealing it is!!!
It will tear out your heart through your WALLET!!

Check this thread "CPO QUESTIONS" by MK4, he delt with the same case as urs, and it turned out it has problems, AND THATS A CPO. so watch out. If it has a clean CARFAX, it may mean that no problems have been reported. But it doesnt mean it didnt have ANY

+1, tough call when the car is out of warranty and you have no personal experience/history with the car. Even if the Carfax is clean, just means nothing was reported....GL
If you are looking for a V8 5 series call George at http://www.dayandnightauto.com and tell him Michael Venegoni told you to call. He will take good care of you. If he does not have a car in stock that you like, tell him what you want and he will find it for you. He moves about 150 cars a month both by dealer request and on the web and lot. The owner of this company is a friend of mine and he has gotten me excellent cars(check my sig). He is a wholesaler so his prices are much better than dealers and he can ship to anywhere in the nation. My latest 545 was bought with only 9222 miles on it a year ago today . He also has connections to every major luxury dealer in the Chicago land area so he was able to get the car CPO's and extended maintenance and 3.9% BMW financing. The same car on the lot when I purchased my car was 43k and I got it for 40k.
