My Ride: 2008 M5 -- Exterior: Silverstone, Interior: Black. Fully Loaded. That just about sums it up! :-)
Definitely a warranty item.
My last BMW had both a stitching problem *and* "premature" dye wear.
Result was a completely new seat.
Judging by the photo they may just repair/replace that section.
Either way, this is certainly a warranty issue.

1. Why on earth would ANYONE do that to their car?
2. The ends of the leather don't look torn, if they'd been well secured and ripped out they would.

My view on the replacement vehicle would be:
1. You have paid good money for a product which is faulty
2. None of this is you fault and the very existance of the problem is an inconvenience for you.
3. In no way should you be further inconvenienced (financially or otherwise) by BMW's rectification of their mistake.
In short, no matter which dealer you bought from, I would absolutely insist on the free use of an equivalent replacement car for as long as it takes BMW to fix the problem.
I have recently taken a similar stance with my dealer who would had no loan cars available for 2 weeks, but needed my car for 2 days.
I argued that I should not have to wait for them to fix the problem and they hired me a car, which I believe was charged back to BMW GMBH as part of the warranty cost recovery.

That looks to be major issue, but be sure and get it in quickly. BMW has some very low mileage cutoff for minor trim complaints. You don't want to delay just in case.

Had a leather problem with the drivers seat on my MY01330ci A auto upholstery guy came into the dealership and took care of the problem no cost to me thanks to JMK BMW.

I did purchase the vehicle from another state. My first experience with BMW North Scottsdale was good. My vehicle had to have a few things replaced. They barely offered to give me a rental though. I questioned about a loaner, and well, was told they didn't do that. I am unsure if they had told me a lie. I don't believe you would have any experience with this only because you never have had to leave your baby over night. BTW, they gave me a 4 Cylinder Mazda6. Which wasn't bad, and I paid something like 18 dollars a day or whatever.
