Trunk compartment release question

My Ride: 530i MSport, Silver Grey, Step, 19" 172 Wheels, Media Pkg inc MP3, Heated Front Seats, Black Leather Seats, Aux Port, Space Saver Wheel, M Rear Spoiler, Ext Voice System
A friend's 2004 E60 (also in UK) can open his trunk using the remote even when the car is locked. My 06 E60 does not do that - I have to unlock the car and then only am I able to open the trunk... My manual also states that in some countries the car must be unlocked prior to opening of the trunk due to some legal issues in those countries etc etc...

I finally got the master key from the dealer and wouldnt you know it, the trunk opens when the doors are locked. Altho why doesnt the spare ( second remote with buttons not the wallet key) do it?
