I agree. However, I think purchasers have a right not to be supplied with a new car in a dangerous condition. My main concern is not that my new car has a fault, but that the problem presented with no warning whatsoever and has potentially life threatening consequences.

Blackcat. How about reporting this issue to the NHTSA. I have included a screen cliping from the 2008 US manual. This issue sounds like it needs to be resolved.. other drivers may not be as lucky as you when, or if, it fails next time.

I don't see one. In the UK the equivalent agency is VOSA (Vehicle & Operator Servics Agency), but they are closely allied to the Society of Motor Manufacturers and Traders and don't have an obvious process for a member of the public (rather than a manufacturer) to highlight a potential safety issue with their car. They do undertake technical investigations of crashed cars, but that wouldn't seem to be too helpful after the fact!

My dealer is still road testing the car and has agreed that I am only getting it back if they can find a fault and rectify it. If they cannot replicate the problem then they have said they will take the car back and try and make arrangements with BMW UK for me to jump the queue getting a replacement (potentially taking a car bound for BMW UK themselves). This is a very reasonable approach in my opinion, although clearly I don't want the car just left on permanent test drive for days on end, so I'll be talking to them tomorrow to try and take the next step if they haven't found the fault.

Just to keep people up to date, my dealer has found an almost identical spec (bar the high beam assist) in the dealer network which is winging its way to West London as I type. SHould be able to pick it up Friday or early next week, and a cheque for ?95 in lieu of the high beam assist. Which is nice. Will post some pics when I have it... the car I mean, not the cheque.
