I own/have owned 4 different 5-series (e34, e39 and e61) and they ALL had/have the same problem, even my brandnew MY 06 e61.
also ALL bmw's of people I know (quite a few..) experience the same problem.
learn to live with it.
That is it. This problem lives with all BMW. I experience that (headlights and side lights with E46, E83, E87, E90 and E60!

Maybe who didn't experience this before didn't wash the car with high water pressure.

Well, Monday was the big day ! Both headlights were replaced under warranty. Great service by BMW folks I have to say.
And yesterday was a rainy day: well, no mist showed up within the headlights. This could be pure luck, I must admit !!! But I'll keep you posted if any condensation comes back. Once again, my dealer was pretty clear about it: the mist they saw when just washing the car (not with hyper-power K?rcher) and which I previously detected just riding along during rainy weather was NOT normal, and they made no big issue of changing both headlights.
I'll keep you informed of the long-term follow-up !
