Got my letter today. Until you get yours, here is the website with information from the lawfirm pursuing the claim,

BMW Class-Action Information

It looks like the only remedy to the general E60 population will be a no-charge service to correct the problem, and as some have said, BMW is already covering repairs under warranty.

Based on this information, I'm planning on opting-out.

If BMW is fixing the problem under warranty, then why the class action? I also got the letter, and it seems my "passenger airbag disabled" light only goes on when my briefcase is on the passenger seat, but does not go on when there is actually a passenger in the seat. So sounds to me like either my car doesnt have the problem, or it was fixed at my last service.

Okay i got the letter today, and started reading the problem and i guess i fall into that category, so do i just go to BMW have them reprogram or join the lawsuit, i don't want my airbags to not work in case of an accident that is scary.

I got the letter today and I am not sure what to do about it. I have never had a problem with the airbag system or light. A lot of class action suits are simply filed for the benefit of the attorneys who file them. The way I read it, BMW fixed the problem quite some time ago and didn't notify everyone that they needed to get a software update. So then these attorneys file suit to force BMW to notify all the owners and demand nearly a millions $US in "expenses & fees" - probably a lot of profit in there. The members of the suit, us, don't get any cash, just a fix that we probably already have if we got a software update for some other reason. Sounds sleazy to me.

I got the notification a few days ago and I believe you did'nt read it right. " THAT HAS MULTIFUNCTION SEATS WITHOUT CLIMATE CONTROL OR SPORT SEATS ". If you have the SPORT SEATS your safe.

I got the letter in the mail, too, yesterday.
Not sure what I am going to do, yet.
BMW has upgraded my SW several times since I got the car 2 years ago. The most recent upgrade was just 2 weeks ago.
It is highly likely that the problem has been fixed with one of those upgrades - but I don't know for sure.

Also the wording THAT HAS MULTIFUNCTION SEATS WITHOUT CLIMATE CONTROL OR SPORT SEATS is inconclusive to me.

You could read it like this:
"(THAT HAS MULTIFUNCTION SEATS WITHOUT CLIMATE CONTROL)" OR "(SPORT SEATS)"
or you could read it like this:
"(THAT HAS MULTIFUNCTION SEATS)" "(WITHOUT CLIMATE CONTROL OR SPORT SEATS)"
