If its not even clicking it could be your starter, or it could be something random like the grounding strap to the engine. I only mention that because the same thing happend to me.

I had a similar problem last year, sometimes starting and sometimes not - no real pattern of wet / dry / warm / cold but got worse and worse.
Changed the battery but no real improvement - read about it here and asked the dealer to look at the starter motor, they changed it under warranty and it is fixed.
The thing I remembered as the real 'tell-tale' was that the engine turned over really slowly when it did start. If you can listen to another E60 starting you will realise how slowly yours is turning over if the starter is the problem, you just get used to it working slowly when it is your car.

My Ride: 2007 530i, Full M-Tech kit, CF Hamann front lip, M5 trunk lid, 20" iForged swift, LCI Tail Lights, Remus Quad Exhaust.
Washed my car the other day, and after about 2 hours or so the car would turn on i drive and all but could not start up, battery had somehow died out as soon as i hit the brakes. Did not leave music or anything playing either, but did have the doors open as i was going in and out cleaning the insides. But after a jump start, I got the seatbelt/airbag malfunction error so now i have to take it to the dealership to clear the code and see if I got a bad battery. Do you guys think i should put my stock tailights back on, in case they blame it on the new lci+bruce cables for some irrelevant reason???
My garage says that my starter is also going to die. When the caris cold, it starts very slowly. With the engine is warm, no problem.
I've found a garage and he could fix it for about 150euros. He will not replace it but he can fix it he says.
