Automatic in Manual Issues

Just when I thought I was going to escape the software issues....
If you have a new E60 in the US, can you shift your auto in Manual Mode? When I go to manual the car is already in M2, and when I try to shift up while driving it flashes betwwen M1 and M3 when trying to upshift to 3rd. When at a stand still in Manual I can't shift down to M1. In other words I can't use Manual. Guess trip to the dealer time.
Anyway experience this?
