if you are willing to wait a few more weeks..my 08 535i will be going returned as my lease will be over and should be taking delivery of my next car early to mid february... (Center BMW or Valencia if they return it to them)

No problem. Don't be afraid of a buy back. My car is from California, and was bought back because of the hpfp issue. It didn't bother me because I fell in love with power the 535s have, it's a blast to drive.

Wynn, I think a GOOD BuyBack would be a great choice for you. We just picked up a 2010 E60 535i With M-Sports for 41k, Guess the miles (: only 7200 on it.
Visit Southcoastmotorsport.com, they have a GREAT indoor warehouse just at costamesa, really great place. They cut about 1-2k off Window/Internet price, and most of their cars are buybacks. Just go there with a positive attitude, and if you find a car you like, ask them for an autocheck report, and the Report stating what has been done to the car to fix the "lemon" issue, the reason for my 535i was due to the HPFP. There was a X6 that was a lemon due to long cold cranks and BMW just replaced the Fuel Injector.
Call up BMW with the last 7 digits of the VIN number, and ask how many years and months remains on the Original Warranty.

I bought my 2008 535i last year from E-CarOne in Carrollton, TX.
23k mi, Sport, Premium, Bluetooth, Comfort Access: $33K

I looked for over a year to find a slightly used manual transmission 535i and finally found one at this TX dealership. I was a bit wary of buying it since I had never purchased a car over the internet. Especially one out of state. My salesman Ryan was very easy to deal with. No pressure, and he was very helpful answering all of my questions and helped me with the minor hassles of buying an out of state car.
After all the data from Carfax, etc. checked out, I decided to put a deposit down and fly out to TX to give my final approval. They picked me up at the airport (in an nice 08 535xi wagon) and had the car waiting for me at the dealership. After a quick stop in the offices, Ryan gave me the keys and said to take as much time as I wanted to inspect the car and to drive it around to decide. Everything met my approval and I drove the car home that day. The long drive from TX to CA made for a great way to become familiar with my "new" car. The car performed flawlessly.
Easy transaction. No pressure and no hassles. Lots of lease return cars available in their indoor warehouse showroom. I have no doubt that I will check out their inventory again when it comes time to replace my current car.
