How many miles on the car? Has the transmission ever been serviced?
Have you checked if there are any trans fluid leaks, especially around the electrical connector sleeve?

It's called a bump downshift and it's a common issue on the ZF 6HPXX transmissions in BMWs as they age. The issue could be as simple as low fluid level from a leaking mechatronic sleeve, as stated above. Fresh fluid, filter/pan, sealing sleeve and resetting adaptions on the TCU may take care of the issue. It may require solenoid or complete valve body replacement. The best course of action is to try the first procedure and see if that fixes the issue and then proceed from there. Check out KyleB's 6HP19 DIY in the DIY section on this forum. Tons of information there.

no LSD...only the "eLSD" that the DSC tries to emulate. It's caused by the transmission downshifting from 2-1 when it's cold. Mine went away after I changed the fluid.
