Buy Back/Trade Assist

My Ride: 2005 Orient Blue/Beige interior 545i: Cold weather pkg, Nav system, Premium sound, Sport Pkg, satellite prep, 30% smoke tinted windows all around, waiting for my euro red reflectors and umbrella!
I have had my car for 5 months now, and I have had to take it in to service 5 times now. 3 times for the check engine light (i-drive control states increased emmissions), one time for a dead battery after I had it 3wks(not my fault), and once for steering wheel vibration and rough ride. 2 PUMA cases, one phone call to BMWNA customer relations, and now I'm just fed up. The car is currently in for service.
I have written a letter to the corporate HQ about this, and now I think a buy back is justified.
Was told by service manager that the dealer sales manager has to authorize the buy back/trade assist. Is this true?? I thought the service manager had to initiate this since it's a technical issue(lemon).
Any info would be helpful

was was that settlemetn if you don't mind, since I have been back and forth to the dealer on numerous occasions for the door seals and I drive and tranny fixes. I'm also think of lemon law suit against dealer and bmw.
