I think it actually is working.
I tried to connect to it, the "call" went out and a recording said "our records indicate you have not registered for BMW Assist....blah blah blah....you may end this call at any time by saying 'goodbye' " to which I said "goodbye" and the recording stoped mid-sentence and said "goodbye".? It definitley recognized my voice command to say goodbye.

It seems the US dealers have found a way to re-configure it, so that BT and assist work.
I just hope all the US dealers know how to do it...

Total cost out of pocket: $7.19*
*There is some possibility I can get an additional $240 back in phone rebates from AT&T (I got two T637's and found a rebate form for $120 ea.) but I'm not counting on it - I signed up through Cingular so I assume they'll pull the ol' Cingular vs. AT&T contract difference on me....obviously that would make this whole deal not only cool but lucrative.?

More than 2 years after this post I have run into the same problem:
I have a 09/03 530i and the TCU was changed under warranty due to a static problem in my radio
I finally got a new TCU 2 days ago and I am told that it is a new model BUT it still doesnt have BT! So I asked the SA why that was since I understand that all new TCUs have BT built in. He told me that since my original TCU didnt support BT, this one wouldnt work and the car cant be retro fitted with BT.
I walked away without much conviction!
Finally, thanks to this post, I opened up my trunk cover today to take a look at the TCU. Here is what I found on the TCU
Part # 84-11-9127060
Date: 28/4/07
This means its is a new TCU. It also has the BT sign on it and more details:
SW: 07-03-08
HW: 09-05-01
BT: 00149A74CC82
PK: 0317
ESN: 102-15331269
I also check and there are 4 wires that go into the TCU including a blue one.
I dont really know what these numbers mean but I think that the SA s not levelling with me. My car is supposed to have a updated software that was done to correct the statis issue.
I am trying to figure out how to get BT and if this TCU shows a BT sign on it then what is required to make it work.
Any help is appreciated.

All of the TCU's installed in NA E60's are BT compatible. The issue of not having the ability to use BT fully is related to the TCU playing nicely with BMW Assist. The updated TCU design provided the ability to have both BT and BMW Assist working at the same time.
If you do have the "updated" TCU, all that should be necessary is to have BT enabled. I have attached the pdf of the now famous SB that addresses updating of the software and enabling BT functionality.
You need to have what is stated in point 4 done, specifically, the dealer needs to perform "Retrofit" of "Tel Bluetooth". If your TCU is an updated model, all you would then need to do is pair your phone and go.
Good luck. Let us know how it goes.
