This case has very little chance of succeeding, IMHO, but it will be a thorn in Apple's side for quite some time to come:

it'd probably settle, lawyers get a huge fee and everyone in the class action gets a 50 cents or some other credits for iTune purchase. What a joke!

LOL, I don't think the end users will even see that much. I am not an Applematon, but I do have an iPod and I really don't see much coming of this lawsuit. If there's even a remote comparison: See Netscape vs Microsoft, Microsoft eventually opened Windows to new browsers, but Netscape died a firey death anyway
