Why not just turn off the engine (but not turning the key completely off?) Sure, shifting to N would help but could also damage the engine, etc.
I can't think of a reason why this couldn't have ended pretty quickly and pretty simply...

The key will always, turn, unless the car was stolen and hotwired!
You'd think the people he was talking on the phone with would have told him to turn off the car...

Doesn't make sense - sounds quite incredible (and unbelieveable) that the accelerator would fail on full AND that at exactly the same time the gear selectror would jam in 'D'.
As with other posts surely in this situation all one would do is:
1. Brake as hard as possible (I am certain this would slow the car below 70mph) - it was only a 318 for goodness sake.
2. Turn the engine off and continue to brake to a halt with hardly any fuss.
I remember a story like this a few years ago where a lady motorist knocked someone over and claimed this happened. As I recall they found no faults with he car and she was prosecuted for dangerous driving.
I have a feeling this guy will end up in court as well.

As I said in the other thread about this, the only thing I can think of is that that torque on the drivetrain at full throttle might make the transmission harder to shift out of D.
Clearly, the driver was a bit clueless and probably panicked...
