So I am waiting for the dealership to call me back still. I would love to get in a new M3 or an x6, but I think i need to downgrade a bit, or maintain where I am. I am not living above my means, but not really in a position to justify a huge lease payment.

I am eyeballing the new 335iS if they let me get out of my lease. If I can get in one for a payment comparable to my 535, i would do it. If I can pick up one with a 6MT for the right price, I am in. I know it has the N54, but I think my car is a minority. I want to feel the difference the 7-second overboost makes. 320 HP 370 ft lb torque.

We will see what my dealership says.

Good luck Craig, hate to see you leave BMW entirely over an exceptionally bad experience. I hope they can get you into one of those cars reasonably

Service Manager was a really nice guy.... Not the salesman says "Just get it fixed and be happy with it" and I say "what, until it breaks again in a month" and he says "Yes. Call me if you want a car that is going to cost you 400-600 more a month then you are currently paying. You got a good deal and there is nothing I can do for you" (this was after I threw the 3 series downgrade on the table. I insinuated at 328 would cost me upwards of $1,000 a month)

So I emailed BMWNA. BTW, the salesman... douchebag named magic. I shit you not.



Agracadabra! I hate BMW and will spend the next year blogging hilarious stuff about my car and the douche salesman with a douche name. If I can stop one person from buying a car from houdini, then I have accomplished my goal.

I HATE HATE HATE HATE HATE BMW with a passion. NEVER AGAIN.

^^^Truth be told, the alternative in Tampa isn't much better. Reeves BMW had a mafia douche salesman nammed vinny or joey or pauly or something that cursed me out over the phone when I didnt buy a car from him- after he found out I got the car elsewhere with the terms I wanted from him but he wouldnt budge. All of that said... Some of the people at Fields BMW are awesome and I appreciate their attempts to help me, I really do. And the Rep at BMWNA was a really nice guy too.

Craig, don't give up on the lemon law angle and concurrently look into getting a meeting with the BMWNA regional representiative that is responsible for your specific dealership. The BMWNA rep can possibly help you with a trade assist/collateral substitution which could get you out of the 535 and into a car that you are happier with. This is the easiest way for BMW to make you happy. This is what I was offered with my 550, which due to more than 30 days out of service was a unqualified black and white lemon under the California rules. Your dealer may or may not play ball but I found they changed their tune when I got the BMWNA regional rep involved. In my case, I started out doing a collateral substitution (where you keep your finance agreement as it but switch out the car for the new one) but due to another dealer mishap I ultimately returned it. Simply put, if you car is a lemon under state law, you call all the shots and can decide what you want to do or are prepared to accept. BMW may be prepared to help avoid you getting to that point by playing nice on a trade assist or collateral substitution. Either way, you do need to escalate this out of the dealer's hands as it sounds like your particular dealer is handling this extremely poorly.
