Maybe they sold it to him like that and told him it was an M5. Sad either way.

People never fail to amaze me!! Just as BMW requires proof of ownership before selling you a replacement key, they should require proof of ownership before selling anyone an M badge...

Except for the fake badge, the car itself looks good....I like the color.
I think the problem with the M classification is that BMW in recent years has really watered-down the whole concept to the point where it'll assign a "M" to just about everything. Now you have a X5M, X6M, and a M-Sport package that can be added-on to just about every model from a 1 series all the way to a 7. It used to be that the "M" designation was something that was very special and assigned to the few flagship models--namely the M3 and M5--that represented the pinnacle of BMW performance. Now, you just tack on a few side skirts, a fat steering wheel and some wheels and bingo, you got a "M!" BMW has shamelessly turned the "M" from what was once an exclusive and respected sporting/racing designation to a "boutique" logo.
Mercedes is also guilty of this. I sometimes see SL550 and CLS550 models with "AMG" right next to the model badge. The AMG designation used to be reserved for those models that met the esthetic AND performance criteria. Now Mercedes uses the AMG logo on pretty much every model that has a cosmetic upgrade. I guess it's all about the $$$.
