There's definitely nothing there to push the cover down.
I worked for BMW during the introduction of the e61, so I've seen lots of e61's and none of them auto closed the cargo cover. There was an option to auto close the liftgate, but in my memory the cover didn't close with it.

could this be just a US thing?? also could it have been updated in the later models of the e61s? we have a 2007 e61.

Well, I'm one of those having the auto-close function in my E61. I can confirm that it does exist. I had a problem with it once when the cover didn't close automatically and I had to close it manually but otherwise it goes automatically up AND down when I open/close the lid or the rear window.

You need option 316 - Tailgate operation, automatic. Opens tailgate by remote, closes via a button on the inside of the tailgate. Load area cover also raises and lowers automatically. It's a ?490 option on a new car, not sure how much to have it fitted on an existing car.

I have the auto function on mine, and it does automatically close the cover when the boot lid goes down....at least it did until 3 days ago. It's been stuck in the open position ever since and I can't physically push it down. Can't see a bleeding thing out of the rear window and it's driving me nuts! I've got it booked in next Tuesday under warranty so if I find out what's up I'll let you know. With it being an electrical operation, I wonder whether it's as simple as a fuse?
