If I was him, I would get a gently used M5 with less than 5K on the meter. The M5's drop like a rock in re-sale and you can get a really nice used one for 15-20K off of original sticker. Now if he has lots of reserve money, then that changes things.

I would rather get the nice used one and spend some extra money on some of the top upgrades for the M5.

My dad won't get into a used car. Plus I wouldn't trust a BMW with only a few thousand miles on sale already. I can almost gaurantee that it wasn't broken in correctly and was for sure driven hard.

I remember the saying, "Drive it like you stole it!"
From what I understand, there are different schools of thought but that's how I would do it if I get an M5.

Agree! There are a couple of cars I would hesitate to buy used; an M5 is one of them...

And as said earlier in this thread, the M-version of the new 5-series (F10/F11) will probably turn up a year after, so that would give your father about three years. A reasonable time for a M5-ownership, I think?

My Ride: E60 M5 Black/Black/Silver trim. Idrive, navigation, Active Seats, HUD, SMG, that plastic Key... and every option except the Active Cruise Control. I asked for everything and dealer forgot Active Cruise.....

I am not big, but I am 6'4" in height. I weigh about 180 so I am quite slim. Height is not a problem. The width may be a problem for your father....
Unless he is Shaquille O Neal size, I think height shouldn't be a problem. But if he is coming from SUburban, Definitely room will be a problem. He might feel clausterfobic...

True. It's all relative really. He will fit inside no problem. But he will compare the 'comfortability' with his last car and will most likely find the M5 seats tighter and more firm and that's how it's suppose to be.
