So it seems they were watching you long enough to notice that you were "weaving in and out of traffic"...and yet they still rear ended you??? Either way they rear ended you and that's a fail on their part. Especially if the report shows the current slow speed of traffic.

you had pictures as evidence, you should have just exchanged info and been on your way.
Which state are you in? I am curious.

As others have said, it was a smarter decision for John to not have move the vehicle and waited for the police to take down an official report. They teach you that in driving school, the basic rule is that unless you are in clear path of danger to yourself or others, leave the vehicle as is. At the going rate of 15MPH, it doesn't matter which lane he's in, every lane IS the fast AND slow lane.

Let's be clear. I'm born and raised in Manhattan, not Long Island. Long Island was not my choice. I consider my living situation in Long Island as "temporary". Hahahahaha!

Man that sucks. In all situations regardless if the person gives me more than enough money to cover damages, I ALWAYS take their license info and insurance info just in case there are more damage that needs to be fixed. We shouldn't be penalized for other people's careless driving and I strongly believe we should never pull out a single penny out of our pockets to get our cars fixed if someone else hits us.

*Knock on wood* I've been hit 3 times in one year, and all of them I took their information even when they originally said "I'll pay out of my pocket I dont want my premium to go up, don't want to lose my job, yada yada yada"... Cuz in the end it turns out they didn't have enough money to pay for the damage and I was forced to file a claim.

I do want to move to Long Island in the future. Or maybe Westchester. Or maybe Alpine in NJ. Gotta save up first.

+10000000000000000!!!!

The other party's insurance will also provide me with a comparable rental car from Enterprise. The claims specialist told me that it will be a similar car to what I have now. Now when did Enterprise start carrying 4 door V10s?? Or something with 500hp? Gonna browse the Enterprise website now.
