John you are a nicer person than me. I would have called the cops in both situations. Just happy that you were not hurt in either incident.

you had pictures as evidence, you should have just exchanged info and been on your way.

This sucks John. I hope everything works out with the car. If anything ever happened to my cars, I always had the adjuster talk to my bodyshop guy, and THEY always negotiated for top dollar. They only considered OEM, never aftermarket. Maybe you should consider going through a bodyshop friend since they usually KNOW the adjusters and can work something out.

I spoke to the insurance company. Claim not processed yet since the other party is denying that they are at fault. They stated I was weaving in and out of traffic. How is that possible when traffic is bumper bumper driving at tops 15 mph??? And the way she braked so hard, it hit the lower part of the bumper. Only way is if I am dead stop and she slammed on the brakes she can hit me at the lower part of the bumper. Unless she has some special air suspension which lowers the car about 8 inches before impact.

I am GLAD I got the police report. turboawd, pictures mean nothing when the other party is denying it. We're in NYC. NYC people are different ESPECIALLY rich Long Island folks who doesn't care about others. When you're at the fast lane driving at less than 15 mph bumper to bumper traffic, it's pretty safe to be there. In NYC traffic, you can walk on the highway blindfolded without worrying being hit. You on the other hand may hit a car while walking. LOL

When I went to the precinct, I thought I brought a blank check. I didn't. THe officer told me to go get a money order and I asked if it was walking distance. He searched for the police report and said "Merry X'Mas, you're good to go." I thanked him like 10 times. I didn't feel like going to get a money order and come back. THUMBS UP to the Officer.

And That is why you ALWAYS get a police report. People change their minds and try to get slick and you end up getting screwed.
I tried to be nice ONCE in the past and got burned by not going the official way and get a police report. F*ck that!! I always get a report and go through the insurance company. That is what I pay them every year for the last 20 yrs, to take care of situations like that.
Pure and simple, We have a "No Fault" state. As long as there were no calls about you weaving in and out of traffic, they can only stall for so long. Have your insurance company supeona the girl's cell phone records to see if she was on her phone and not paying attention.
I bet she was. Anytime you are rear ended if you have to go to court to fight it out, Always supeona phone records to check for "distracted" driving due to being on the phone.
