Just to update you all, they did a software update to see if that would remedy the problem but it did not.

the problem was Both bank one and bank two Idle actuator valves... 1,500 dollars worth of parts plus labor would be 2,300!

thankfully i have a good relationship with my dealership (habberstad in huntington, NY) and they were able to get BMW NA to cover the parts so I just paid labor even though i'm out of warrenty! seriously can't say enough good things about my service experiences at this dealership very nice guys

lol no sorry that was worded badly, Parts and labor together was 2,300... the parts were 1,500 out of the 2,300 so I paid the difference (700)
