Man that sucks. I thought I had heard some folks on M5Board that were able to get their clutch replaced under warranty. Seems like the issue is still not clear cut.

Eddie,
I had no clue you got rid of your car?? When was this and what are you driving now?

Man that is scary. How much does replacing the clutch run for? Is it that outragous? I would have a indy shop look at it before you make a choice as to what you want to do.

Where did you buy your car? Two weeks after the purchase - you should be either returning the car to the seller or getting the seller to pay for this repair.

If that is not an option, I still believe that your car should be fixed free of charge for you, or for a nominal fee - not 3 g's. Since BMW of Manhattan is owned by BMW NA, I'd try every possible argument to convince them to perform this repair under warranty for you.

Your car is cpo'd I thought? You've had it for 2 weeks. If they tell you they're not replacing it I'd be in the dealer ubought it from ready to burn it down. Did u buy it in NY or out of state? Like Tony said slot of people on M5board had it replaced under warranty. Btw u can't lemon law as a 2nd owner. The law route takes forever, absolute last resort. I've been fighting with Ford on a 2008 F450 that had the head gasket replaced 3 times for over a year. Good luck either way and don't let them push you around

Those SMG clutches are not cheap. My guy on Long Island can do the swap for half the cost of the dealership. He's done a few friends.

Damn! So they're explicitly saying this is a wear-and-tear item and not covered under the warranty or maint plan?

Try calling another dealer.

WHAT! was there even signs of abuse? that concerns me... if the clutches goes out at 40K miles with $4600 + tax thats crazy... what happened to clutches lasting over 100K miles? (when driven normally) that clutch must have been abused or something...
