What people are saying about the height diff is correct - I had an Eibach pro kit installed 2 months ago and I can confirm the driver's side is about 1/4 inch (5mm) higher than the passenger side. I had my wife measure it while I was seated in the car and it was equal allaround ! Nice touch BMW !
With regards to that foto, it seems the spring could be rotated to the rubber seal stop end, but other than that, the springs are sitting correctly.

BMW of Peabody has confirmed that the driver sides (for E60) are 3mm - 5mm higher than the passenger sides.... It makes me more comfortable know..
If you have different opinion or think that the BMW (that confirmed this) was wrong, LET ME KNOW...

I'll try and take a picture of my H&R's this weekend, on my car. Sorry to hear about your troubles. Don't worry though...this is just a little bump in the road. You'll have your car back to normal in no time and will be enjoying it for years to come.
