There is only one way to get your money back. Contact Paypal and they can put the charge on dispute including shipping.

If the item is defective and you didn't return it because you didn't like it or change your mind he should refund shipping as well. Its not your fault a seller misrepresent his item.

In those situations any verbal communication is pointless. ALL should be in black and white.

right
if so why have you not got all your money from the seller?
I would begain a case on ebay and paypal so that they both will sort the guy out that sold you the goods.
At 1 time I got a person baned on ebay cos he did not refund all the money back to me cos he did a runner, it was only $40us.
so I reported to ebay and paypal and after about 2 months paypal refund all the money to me, not the seller.
so all the amount that you payed to the seller with paypal, you will100% get it back.
Just send all the emails to paypal and they will look into it.
I would not thet the seller go that easy,
