The are a safety feature only when used corectly (visibility <50mtrs), but as always they are misused. They cause serious distraction at night.

The caption in the piicture says (bulbs here, not LEDs) in parenthesis. I don't believe there was a claim that the Active Brakelight system included LEDs.
If BMW ever does start using LEDs for the E60 I hope that it will be for both the brakelights and the taillights, like the E65 and E63. Maybe even the turn signal like the E46 coupe.
In 1984 I imported a German model E30 323i to the US and it had rear foglights in both taillights. Since then I have owned many US model BMW's and none of them have had rear foglights (even though MB, Audi, and Volvo have them). However, the location for the foglight is usually available in the taillights with no bulb installed (and no wiring either), or one of the already installed bulbs has a brighter filament which is the Foglight in Europe and can be wired up to turn on in the US. This was the case on my E36 M3. I bought the European foglight switch which had both front and rear foglight buttons on it, so I was able to wire the rear foglights myself. I read somewhere last year (RoadFly maybe???) that BMW NA had instructed the US dealers to install rear foglights for any customer that requests it, but I have NO confirmation on this.
From the pictures that Flowerfred posted it looks like on European models there is either a dual filament bulb in the round section, or BMW uses two different voltages to light up the bulb at two different brightness levels. I don't know whether the US Adaptive Brakelight System lights up the round section at the dimmer or brighter level. So it may be possible to wire up the light bulb to be used as a foglight as well. However, it may make the ABL useless when the foglights are on. I may experiment a bit when I get my car.

If you want to install rear foglights I would suggest installing it the German way, so you will even have the ABL working. ABL will light up the second bulb then...
