Yes its a fake. You can tell by the shifter. On the M5 smg it sits a little lower.

The brake pedal on the M5 is narrower (same as a manual), while Steptronics and regular SMG's have the wider brake pedal. The mufflers on this one look like they are an oval can muffler with a single outlet splitting into a dual tip (like a Y-pipe), while the M5 has two cans on each side with one tip on each can
Having said that, it would be hard to tell if you just saw it parked somewhere, unless you inspected it up close.
