Sorry for your troubles
This is the first platform where I've seen zero concern over things rubbing when the engine isn't even running. It takes a lot of muscle to get onto the throttle body out of the box.
Mine is still real close but clearanced enough for install. I hit it pretty good with a baby sledge to massage clearance

Just to add to this thread, as I replied to cqhall's thread and linked this one
I too share this problem, and I attempted to clearance in a similar fashion and didn't bother putting it back on.
I have to wiggle the pipe around way too much to get it into place and it sits all funky on the throttle body.. etc.. Hopefully BMS will re-design and offer a steep discount to people who purchased for the E6x platform and had to "beat the hell out of the pipe" to make it fit..

Hopefully BMS will issue an update. After a lot of emails with them and this thread, I'm almost certain that they don't know it doesn't fit. And if they do know it doesn't fit, that's messed up. Actually, either way is messed up.

Biggest difference is I don't think my factory charge pipe was sealed well under boost. Car runs a bit better between mid and full throttle
As far as turbulence, there's no drastic or sharp dents inside the CP. If I did the math it'd be a minimal difference in cross sectional area.
Install was definitely a pain and I still think it should fit better than it does. Lessons learned. I can't honestly say for sure other products fit better but this was an experience

I had the same problem in my 08 535i. Bought the Burger pipe with Tial BOV and obviously shouldn't be advertised as a 535 option for the reasons you have all mentioned. I didn't want to relocate my power steering reservoir or bend the bottom (dent) my pipe to clear the hard lines underneath it. But left as is, it would leak a bit at the throttle body under boost. So it still sits in the box in my garage and I just ate it. Burger wouldn't even take it back all though it wasn't ever used. I ended up paying more but went with the ER pipe as it fits the E60 5'er like a glove. If anyone wants a burger pipe with a Tial flange let me know. Has a small scratch on the bottoms where it was pressed against the mentioned hard lines

Tea I think we can push a bit more. The emails I have from BMS are very telling. The person I was talking with (emailing) said I should've picked the pipe that doesn't say "non 535" Wich I didn't pick that one. What the drop down menu says is that the pipe they sell that uses the factory diverter valves will not for the N54 535. So what do you do? Pick the next one on the drop down menu with the Tial blow off flange as it doesn't state "non 535". After I informed them the website is this way and misleading they emailed saying they would fix it as they didn't want other unhappy customers. That was almost exactly a year ago and the website is still the same except now the have a "higher end" elite model that is wrongly listed and misleading as well. Guess they don't mind. Considering I bought nearly $2100 of stuff from them in a month period you think they would refund the cheap pipe ($129) but I dice, even once it was 💯% proven that they mislead the purchase I made. Oh well. The Evolution Racing pipe fits so nice and the quality is awesome, perfect welds, fittings, etc. Sure it about $260 with a Tial BOV flange ($230 if you want to use your factory diverter valves but that's a bad idea), it's so worth the NON-HASTLE in my book. Now what to do with this damn charge pipe. Know and 135/335 folks? Lol.

Put an Evolution Raceworks charge pipe on - fit just like OEM.
No hitting it with a hammer or anything.. such a shame I wasted 120+ dollars on the BMS..

Wow, glad I found this thread to verify I wasn't losing my mind. I tried fitting the BMS charge pipe a couple times in my '08 E61 and the angles just seemed wrong, plus, as mentioned, the power steering lines were in the way. E-mailed BMS with a photo very similar to the first one in the thread to verify I had actually received a 535 pipe and they said yes. Like others, I decided to just eat the cost (didn't even bother trying with a return since I got behind and it was months from delivery before I initially tried to fit it). I ordered an ER pipe last week, so good to know that should fit fine!
