Ok, I'm back in the office. Drove with the foreman for a good 30 minutes or so and he once again agreed with all my concerns- trans shifting issues, grinding brakes/brake noise, and unusually loud crackling from the exhaust/cats.
He said he would jump on the phone with BMW this morning re: the trans. He mentioned that if it needed a new tranny, it would get a new tranny. He also said teh brakes issues and exhaust/cat issue would be resolved today. In the meantime, I'm driving an Xterra because they were out of BMWs.

At least they have your car in for repairs thats a good thing. On the other hand my issue is not as bad as yours it only happens when I get into the car in the morning, start it and drive off without the car warming up.
Correct me if I wrong but I think most of you guys that own 08's may not have as many stops as I do before I can drive for a while without stopping.
When I leave my parking spot I have to stop and slow down for 5 speed bumps and 1 stop sign. Then I have to stop for the light before I can get to an open road or the highway. It's either at the Stop sign, if i'm stopped for a short time, or at the red light that the slam occurs after I release the brake. I'm starting to think because of all these stops I notice the issue more than most of you. You all come out of a driveway and drive without stopping so your cars get to warm up.
Once I'm driving for a few minutes and the car warms up the issue goes away and does not occur again. It's usually in cold starts that this occurs and BMW is aware and has a fix for it. I'm at this point now because they fixed mine, oh so we thought, based on the bulletin for the trans issue.
Your car definitely sounds like it has some serious issues. Glad they're fixing them and I hope it all works out.

Ok, back home again!
Foreman says that BMW in New Jersey (?) would not approve any action based on the description of the information given (verbally) and the car's information that was downloaded and sent to them for evaluation. They said everything is just fine.
I'm going to pick up the car tomorrow morning, stop by and visit Wayne, install his sprint booster and see if the problem is still there. I'm sure it will be and it will be a sign that it's a trans issue not an SB issue. After that, I'm going to go back to BMW, test drive a used 550i to confirm how it drives compared to mine. If there is no difference well then I guess I'm stuck. If there is, I'm going to try and make a case and then speak to a reputable lemon law lawyer.
