Still havn't gotten my 2008 535xi

I ordred my 535xi Jan 23rd. Instead of brand new from factory I agreed to take one they had exact same as the one I would have ordered but from Calgary brand new with under 20k so I could have it sooner instead of about 2 months. I am located in Toronto so I said OK. I gave half of the $6k you need to give but didn't sign anything yet. Was told it would take 5-7 days. Its now Feb 13th, exactly 3 weeks from order date and they said they expect it this week, but I phoned the dealer today and was told they're not sure when I'll recieve it. What should I do? Get my $3k back and order brand new from another dealer or just wait it out? Should I ask for some refund? I have been without a car for nearly 1 month now.

Sounds to me like the trade the dealer thought they had fell apart and they're looking for another similar car. There are enough new 535xi's out there - shop elsewhere. But unless a legitimate dealer will give you a contract ... don't offer money in advance except for a small good-faith payment.

I ordered my 550i last month and when I offered to leave a deposit my sales guy laughed & shook his head. One of the many reasons I continue buying there.

There is a written agreement but nothing was signed. I told the sales rep I will sign everything when I pick up the car and gave the other $3k
I just don't like being lied. Telling me an approximent delivery date and 2 more weeks later still not having it. I think that if I don't get the car by friday I will cancel unless I get more money off.

I don't mind the delays if I am being told the truth - it's the places that tell you one thing to get you to say "yes", then stall you as they knew all along it would take a lot longer than they were saying. If they are honest from the start, no problem IMO. Sounds like maybe this was the case here.
I don't quite understand - the one in Calgary is used, but you really wanted a new one? A new one will take 60 to 90 days no matter what so you'll still be way ahead if the Calgary car shows up soon; and, I assume, you are paying less than new price for it.
It's winter and the roads are messy anyway....
BTW, the dealer here has a nice Alpine White 535xi on the lot, they would be happy to sell it to you. Black leather, with poplar trim. Like mine, but no MSport package. PM me if any interest.

thanks for the info. it isnt a used car it is brand new. i told the sales rep i don't want it if it has over 50km. but he said it is brand new sitting in the lot. im just assuming itll have 5-20kms on it is what i meant. he said only 5-7 days instead of 2 months or so from germany so i said ill take the one from calgary. and i totally agree if he was straight up from the start id have no problem. its just being lied to. i am teling him tomorrow that if i dont have it this weekend i am going to another dealer.
