My Ride: 2004 545i - 6 speed manual (July 04 build), silver-grey/black, sports package std equipment (18", active roll, active steering, adaptive headlights), premium sound, bluetooth enabled, folding rear seat, lumbar, 3m hood/bumper protective film, rear tint, euro reflectors.

I bought a CPO 2004 545i Sport Package and found out later that it didn't have the Sport Package installed. The dealer simply put on the Sport Package wheels and tires and sold it to me as a "sport". It should be easy to verify whether it has active roll and active steering. That will tell you whether there was cosmetic changes or whether it has the factory sport package.
The M-Sport is completely different - body trim and wheels and was not even an option in 2004.

Anybody on this board would notice that the car had no M-Sport body kit, had chrome window trim, no sport seats, no sport steering wheel ... I think what really happened is that the buyer didn't really understand what he was buying and just misunderstood. Sorry to be harsh, no offence is intended, but I'm not convinced the dealer is at fault here.
Its a 2004 it wouldn't have the M-tech body kit.
Since he has only be a forum member since the end of July and had only two posts. Maybe he is not as informed as many members on this site. Ease up a little buddy. The average buyer, if it states "sport package", he/she is going to believe it has a sports package.

The sport seats with the extendable thigh supports should tell the tale whether or not this a dealer modified vehicle or the real thing. The VIN number will also have all the info that you would need IDed through BMWNA.

I've seen this practice done a lot on ebay, all these car lots that go on line advertise E60s with sport package when it does not have it, they do that with NAV as well. The untrained eye could easily believe that a car has the sports package.
I think the easiest way to tell are the seats. Never judge by the trim or wheels.

I don't think there is a difference in the bumpers or side skirts, at least not on the 2004. Explain what you mean by the "log book". I'm not familiar with that. My insurance company doesn't care about sport or not sport equipped. The invoice just says 545i. I don't think there's a difference in the steering wheel, but it does not have sport seats. The car is a BMW CPO car.
