Just called the garage and they say that the car broke a conrod and its mashed loads of the engine its put a hole in the engine casing. It needs a replacement engine so the garage is sourcing one for for me. Cost is probably going to be north of 2 grand.
If you still withing the mileage you can get replacement engine from BMW for free, cause even the oldest E60 (2003) is not 8 years old yet.

My Ride: 2010 M5 alpine white, black full leather, etc.
I assume that is your entire supply of engine oil or transmission fluid on the road surface, that your vehicle has no warranty, and there is no immediate solution.
This might be the time to do as quick a fix as possible and look around for new transportation.

I wouldn't be so fast on the trigger. You could try contacting BMW directly and try to find out how they feel about this type of failure on one of their high end cars. You might be able to get them to chip in for parts while you take care of the labor or maybe split the cost 50/50. I don't think this is an every day occurrence and it could be a defective part in your particular car.
Glad to hear that your family's fine. Keep us posted. G/L

Hi all and thanks for the advice and messages. There was only 61k on the clock and its in really good condition so its a mystery why the engine would fail so badly - its has a full service history I've phoned BMW and left a message and emailed as well so I'll let you know how I get on.

if youre the original owner, and all the proper previous service was done at a BMW dealer, then i dont see why bmw WOULDNT at least pay for half (if not all)...that shouldnt happen unless someone beats the crap out of their car and/or completely neglects it.
keep us posted and good luck.
