my car did that pulling out of the dealer. i pulled back in and they fixed it in 30 seconds. your dealer sucks
Or did they just take an OBD to it and clear the code....

Mine's at the dealer right now for that same thing. Mine started shuttering really bad when the light came on...I think this is called "limp mode". So I "limped" to the dealer. When hooked to the computer, they saw a #3 cylinder misfire. Computer's instructions were: First step - download latest software...this is suppose to address misfires, the turbo lag issue that was reported in the previous software, and I'm sure a bunch of other stuff. If new software doesn't fix it, then go to second step. Second step - investigate high pressure fuel pump.

still under warranty thank god, but i hope it is not a fuel pump, when i first start it i it feels like its going to to die as it idles after it warms up its fine

Sounds symptomatic of the High Pressure Fuel Pump issue on 2007 and 2008 N54 equipped cars. I just got my letter from BMW last week announcing they had extended the warranty on the pump to 120K miles or 10 years due to the high number of failures on this part.
