I filled up my windscreen washer and noticed fluid coming out a pipe further up the car on the right hand side, is this an overflow pipe or should it be connected up somewhere ?

yes its an overflow and used to clear the filter in the water tank if it blocks.
mine blocks a few months ago so they blew into it with a compressor and filled it with water to clear out the dirty water and it worked.

Overflow doesn't exist on 2008 535i so oddly must be engine or year specific.

Hmmm... I saw that tube while washing my '08 550 over the weekend and wondered what it was for. I guess it's on 550's as well then.
