Thanks for the advice, but I'm going to wait and see what BMW NA comes up with in the next couple of days. In Texas, you have to start the process with the state and a $35 fee. Then give the dealer an opportunity to fix it. In the end, it is up to the state as to whether the situation is lemon worthy.
